The prosecution contends that Kimberly Renee Poole had reason (motive) to have Brent murdered, that she wanted to be with John Boyd Frazier. Here’s our breakdown on why the prosecution’s theory is false.
Two cards from Brent apologizing
In the cards Brent wrote about not wanting to lose them both (Kimberly and his daughter Katie)
During their brief separation Brent gave Kimberly two cards. In the cards he wrote a heartfelt apology for how he had been treating her. “I don’t want to lose you two,” he would write acknowledging that Katie would stay with her mom. This acknowledgement debunks the prosecution’s false theory that Kimberly had Brent murdered because if she left him she’d lose custody of Katie. Brent acknowledges and accepts that Katie would stay with Kimberly. There was no threat of having Katie taken away from Kimberly.
The storage unit
When Kimberly moved out in early May she stored most her property in a storage unit
Around early May 1998 Kimberly briefly separated from Brent and moved out of the house. She moved in with John Boyd Frazier only as a temporary living solution until she could find a place of her own. John Boyd Frazier assured her that he’d be working a lot and wouldn’t be home often anyways. Kimberly insisted he rent a storage unit and she stored most her property in this storage unit. She was only separated from Brent a very short time, less than 2 weeks, and moved back in with Brent to reconcile after he basically woke up, apologized and recognized the problems in their marriage. Brent and Kimberly together both went back to this storage unit to get her property. Kimberly’s use of this storage unit supports what she said all along, that she only moved in with John Boyd Frazier as a temporary living solution, that she never intended to stay at John Boyd Frazier’s house longer than necessary to find a place of her own. This evidence that she placed most her household items in a storage unit was never brought up by her defense at trial, just one of the many negligent omissions and errors of her defense counsel.
The confrontation May 30th and the email May 31st
On Saturday night May 30th Kimberly and Brent ran into John Boyd Frazier on their night out
The couple were at The Silver Fox and John Boyd Frazier would be there too and caused a scene, and in the parking lot challenged Brent to a fight. Brent pulled over on their way home and told Kimberly they couldn’t live like this. Kimberly agreed and suggested they get a restraining order. The next morning, Sunday May 31st, John Boyd Frazier would email Brent and try to persuade Brent that Kimberly wasn’t worth it, to leave Kimberly telling Brent that she will just keep cheating with others, that Brent was a fool to take her back, bashing Kimberly throughout the email. John Boyd Frazier would also write that he too was a fool to have an affair with her and imply that they shared something, a bro bond, in both being fools. In closing he wrote he had more information about things she had done without his knowledge in hopes that Brent would contact him. Brent didn’t take the bait and never replied to his email. It’s clear that John Boyd Frazier was trying to throw a wrench in their reconciliation by sending that email, bad mouthing Kimberly and trying to bro bond with Brent. Kimberly’s suggestion that they could get a restraining order and John Boyd Frazier’s actions throwing Kimberly ‘under the bus’ support reasoning that by this point (end of May) there was no romantic feelings between the two.
The dayplanner
John Boyd Frazier literally writes Kimberly off May 31st
John Boyd Frazier would memorialize that weekend in his dayplanner writing on May 30th “Renee gone forever” and then on May 31st “Fuck you Renee”. This would support reasoning that by this point there was no romantic feelings between the two. Given that John Boyd Frazier had basically written Kimberly off entirely by the end of May, it seems unlikely he would be the assailant in Myrtle Beach the night of June 9th.
Brent’s new wardrobe
A week or two prior Kimberly had just spent a few thousand on new clothes for Brent
A week or two prior to their trip to Myrtle Beach Kimberly had spent a few thousand on a new wardrobe for Brent. She had bought him new clothes and this was brought up at trial but the defense was negligent in not preparing the required proof (pictures) of the clothes to match the receipt. Marie Summey provided receipt evidence that was objected to by the prosecution and let stand by the judge, because they could not prove the receipt purchase was for Brent’s clothes. Detective Altman (who went to the hospital with Brent) even remarked the night of the incident that Brent was clothed in all designer clothing, that he looked like a Tommy Hilfiger. It wouldn’t make sense for Kimberly to spend that kind of money on new clothes for Brent if she wanted him dead or knew he would be murdered soon after.
The life insurance
Brent’s life insurance policy was for just $31,000
Brent’s life insurance policy was taken out January 9, 1997. It was a policy just for $31,000. It was a standard precaution any couple just having a baby would take out. The life insurance policy was not amended at a later time to increase payout. This was the policy in place at Brent’s death. Kimberly and Brent were a young married couple doing well financially. They had owned their own home since 1996 and Brent was making decent money as a highly skilled ASE certified master mechanic. Kimberly’s strong desire to work and the money she was making as a part-time exotic dancer–on par with Brent’s full time weekly salary–enabled the young couple to realize home ownership. It wouldn’t make sense then that Kimberly would have Brent killed for the life insurance money as she had the ability and the means to work as an exotic dancer making as much money as Brent, even more. Kimberly could make that life insurance payout in less than a year working as an exotic dancer.
