Juror Jarid Hardee was witness to the misconduct in the jury room. He would later publish his account of what happened.
The jury was split 6/6. Twice the jury sent messages to Judge Cottingham they were deadlocked. After nearly 10 hours of deliberations with no breaks, and no smoke breaks, just like with Kimberly’s false confession, the opposing jurors were worn down to comply. After nearly 10 hours and being a smoker, juror Jarid Hardee switched his vote in order to smoke. Others switched in order to leave being that a deadlock was not accepted.
